1. Acceptance of Terms
By using QuotigyDash ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
⚠️ Important: These Terms constitute a legally binding agreement between you (the user) and QuotigyDash.
2. Service Description
QuotigyDash is a software application for managing quotes and invoices available in two editions:
2.1 Server Edition
- Self-hosted web application based on Laravel
- Requires installation on user's own server
- One-time purchase with perpetual license
2.2 Desktop Edition
- Desktop application for Windows (Electron-based)
- Includes integrated PHP environment
- No server installation required
- One-time purchase with perpetual license
3. License to Use
3.1 License grant
QuotigyDash grants you a personal, non-exclusive, non-transferable, and revocable license to use the software under the following terms:
- Server Edition: license for single server installation
- Desktop Edition: license for use on a single computer
3.2 License restrictions
You may NOT:
- Resell, assign, rent, or distribute the software
- Modify, decompile, or reverse engineer the code (where applicable)
- Remove or modify copyright notices or trademarks
- Use the software for illegal purposes
- Install the same license on multiple machines/servers simultaneously
3.3 Intellectual property
QuotigyDash and all related intellectual property rights remain the exclusive property of QuotigyDash. The license does not transfer any ownership rights.
4. Account and Security
4.1 User responsibility
You are responsible for:
- Maintaining the security of your login credentials
- All activities occurring under your account
- Immediately notifying QuotigyDash of unauthorized use
4.2 Data security (Server Edition)
For the self-hosted Server Edition, you are responsible for:
- Server and infrastructure security
- Regular data backups
- Compliance with applicable regulations (e.g., GDPR)
- Protection from unauthorized access
5. Payments and Refunds
5.1 Pricing
Prices are displayed on the website and may be modified at any time. Changes do not affect purchases already made.
5.2 Payment methods
- Website purchases (Desktop and Server Edition): via Lemon Squeezy (credit card, PayPal). Lemon Squeezy acts as Merchant of Record.
- Microsoft Store purchases: according to the payment methods handled by Microsoft
5.3 Refund policy
Given the digital nature of the product:
- Website purchases (Lemon Squeezy): 30-day money-back guarantee from the date of purchase. Refunds can be requested directly through the Lemon Squeezy payment platform.
- Microsoft Store purchases: the Microsoft Store refund policy applies
Note: Refunds are at QuotigyDash's discretion and will only be granted in case of unresolvable technical defects or non-compliance with product description.
6. Updates and Support
6.1 Software updates
- Minor updates (bug fixes, security patches) are free
- Major updates (new features) may require a paid upgrade
- QuotigyDash reserves the right to discontinue support for obsolete versions
6.2 Technical support
- Basic support is provided via email: info@quotigydash.com
- Response time: within 48 business hours
- Support covers software-related issues, not custom server configurations
7. Limitation of Liability
7.1 Warranties
QuotigyDash is provided "AS IS" without warranties of any kind, express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Absence of errors or interruptions
7.2 Disclaimer of liability
QuotigyDash will NOT be liable for:
- Loss of data or profits
- Business interruption
- Direct, indirect, incidental, or consequential damages
- Problems arising from incorrect server configurations (Server Edition)
- Hardware/software incompatibility
⚠️ Important: QuotigyDash's maximum liability is limited to the amount paid for the software license.
8. Data Protection
The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms.
8.1 User data (Server Edition)
For the self-hosted Server Edition:
- You are the data controller for data entered into the software
- You must comply with GDPR and applicable regulations
- QuotigyDash does not have access to data stored on your server
9. Termination
9.1 Termination by user
You may cease using the software at any time by uninstalling it and destroying all copies.
9.2 Termination by QuotigyDash
QuotigyDash reserves the right to revoke the license in case of:
- Violation of these Terms
- Fraudulent or illegal use of the software
- Non-payment (where applicable)
9.3 Effects of termination
Upon termination:
- You must immediately cease using the software
- Uninstall and destroy all copies
- No refund will be due except as required by law
10. Changes to Terms
QuotigyDash reserves the right to modify these Terms at any time. Substantial changes will be communicated via:
- Email to registered users
- Notice on the website
Continued use of the software after changes constitutes acceptance of the new Terms.
11. Applicable Law and Jurisdiction
These Terms are governed by Italian law. For any dispute, the Court of Rome has exclusive jurisdiction.
12. Severability Clause
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
13. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the parties and supersede any prior agreements.
